Changes of Guardian Power in Modern Society

Abstract: The guardian, took family——modern society’s basic cell the representative, is playing the vital role to the stability and the foreword movement of the family, therefore, how to determined guardian’s right has the suitable significance regarding the modern family. This article attempts to explain what type pattern the guardian power which originated from the Roman law is in modern civilized days and can it also be suitable with today family condition because social economy, life and so on various aspects condition change through analysis to the successional variation process of guardian right, and puts forward my own proposal on the guardian right system design to our country’s civil law statute book.
